Before you train

Health disclaimer, assumption of risk and release of liability. Last updated October 13, 2026.

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CLAIMS FOR INJURY, INCLUDING CLAIMS BASED ON OUR NEGLIGENCE. IF YOU DO NOT AGREE, DO NOT USE WORKOUT GEARS.

Workout Gears is provided by Rebel Phoenix Games LLC (“we”, “us”). In this notice, “Workout Gears” means the app, this website and everything in them: workouts, combinations, techniques, exercises, poses, illustrations, descriptions and the coaches’ voices.

1. Not medical advice

Workout Gears gives general fitness and martial-arts training guidance for information and education only. It is not medical advice, diagnosis or treatment, and it does not replace a doctor, a physical therapist or a qualified instructor. Using Workout Gears does not create a doctor–patient, trainer–client or any other professional relationship with us. Never ignore or delay professional medical advice because of something in Workout Gears.

2. Check with a doctor first

Talk to a physician before starting this or any exercise program, and before changing how hard or how often you train. This matters most if you are pregnant or recently gave birth; are over 40 and have not exercised regularly; have or have had a heart condition, high blood pressure, chest pain, dizziness or fainting, asthma or another breathing condition, diabetes, epilepsy or seizures; have a bone, joint, back or neck problem or a recent injury or surgery; take prescription medication; or have any other condition that exercise could make worse.

By using Workout Gears you confirm that you are in good enough physical condition to exercise, that you know of no medical reason not to, and that if a doctor has advised you against exercise or any activity in the app, you will follow that advice.

3. Stop if something feels wrong

Stop immediately if you feel pain, dizziness, faintness, nausea, chest pain or pressure, an irregular heartbeat, unusual shortness of breath or anything else that does not feel right, and get medical help. In an emergency, call your local emergency number. Workout Gears cannot detect an emergency and cannot call for help.

4. No one is watching you train

Workout Gears is a voice that calls rounds. It cannot see you, and it does not measure your heart rate, your form, your fatigue or your surroundings. Nobody supervises your workout or corrects your technique. The workouts are not designed for you personally: they are general content, built from the choices you make on the dials, and they may include movements that are not suitable for you. You decide what to do, how hard, how long and whether to skip, change or stop any round.

5. Train in a safe space

  • Clear the area around you of furniture, people, pets and anything you could strike, slip on or trip over. Train on a stable, non-slip surface with enough room to move in every direction.
  • Use suitable footwear and equipment in good condition, and use weights and other equipment only as their makers direct and within your ability.
  • Martial-arts techniques in Workout Gears are for solo practice in the air. They are not instructions for partner work, sparring or contact. If you choose to use a bag, pads, a partner or any equipment, you do so at your own risk.
  • Warm up, drink water, and do not train when you are ill, injured, overtired or under the influence of alcohol, drugs or medication that affects balance or judgment.
  • Keep your music and the coach at a volume that lets you stay aware of what is around you. Do not use Workout Gears while driving or anywhere it could distract you from a hazard.

6. Martial-arts content

Technique names, descriptions and histories are training and educational content. They are not a promise that any technique will work, and they are not self-defense advice. We make no claim that practicing with Workout Gears will keep you or anyone else safe in a real confrontation.

7. The risks you accept

Exercise and martial-arts training are physically demanding and carry risks that cannot be removed, however carefully you train. These include, among others: muscle strains and tears, sprains, joint and ligament injuries, broken bones, back and neck injuries, falls, collisions with objects or people, injuries from weights and other equipment, overexertion, dehydration, heat illness, the aggravation of an existing condition, heart attack, stroke, permanent disability and death. They also include damage to property and injury to other people near you.

You understand these risks and you voluntarily accept all of them, known and unknown, whenever you use Workout Gears. You are solely responsible for how, where and how hard you train.

8. Release of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU, FOR YOURSELF AND FOR YOUR HEIRS, FAMILY, ESTATE, INSURERS AND ANYONE ELSE WHO COULD CLAIM THROUGH YOU, RELEASE AND GIVE UP ALL CLAIMS AGAINST REBEL PHOENIX GAMES LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, SUCCESSORS AND ASSIGNS (THE “RELEASED PARTIES”) FOR ANY INJURY, ILLNESS, DISABILITY, DEATH, LOSS OR PROPERTY DAMAGE ARISING FROM OR CONNECTED WITH YOUR USE OF WORKOUT GEARS, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, AND YOU AGREE NOT TO SUE THE RELEASED PARTIES FOR ANY SUCH CLAIM.

This release covers claims you do not currently know about or suspect. If you live in California, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You waive any similar law of any other place.

This release does not apply to gross negligence, recklessness, intentional misconduct or fraud by a Released Party, or to any liability that the law where you live does not allow to be released.

9. If someone else is affected

You are responsible for anyone you allow to train with your account or alongside you, and for any harm you cause to other people or to property while using Workout Gears. To the fullest extent permitted by law, you agree to indemnify and hold the Released Parties harmless from claims, losses and costs (including reasonable attorneys’ fees) that arise from your use of Workout Gears, from your breach of this notice, or from a claim brought by someone who trained with or near you.

10. No guarantees

Workout Gears is provided “as is” and “as available”. We make no promise about results, fitness, health, skill or safety, and no promise that the content is complete, accurate, error-free or suitable for you. Illustrations and descriptions are simplified and may contain mistakes.

11. Age

You must be 18 or older to use Workout Gears on your own. If you are under 18, you may use it only with the consent and supervision of a parent or legal guardian, who accepts this notice on your behalf and is responsible for your training.

12. Where the law limits this notice

Some places do not allow certain disclaimers, releases or limits on liability, so parts of this notice may not apply to you, and nothing here removes rights that cannot legally be waived. If any part of this notice is found unenforceable, that part is limited as little as necessary and the rest stays in effect.

13. How this fits with our other terms

This notice is part of the agreement between you and Rebel Phoenix Games LLC, together with the Terms of Service and Privacy Policy. In the app, you are asked to accept it before your first workout. By accepting it, or by using Workout Gears, you confirm that you have read it, understand it, and agree to it freely.
